Qstation.com and its associated web sites are owned and operated
by Atypica, Inc. (collectively referred to as "Qstation")
ANY PERSON OR ENTITY ACCESSING THE QSTATION WEB SITE AND THE INFORMATION
CONTAINED HEREIN ("User") SHALL BE BOUND BY THIS USER AGREEMENT.
BY COMPLETING THE REGISTRATION PROCESS AND CLICKING ON "SUBMIT"'
YOU ACCEPT AND AGREE TO THE FOLLOWING TERMS AND CONDITIONS.
Modification to Services; User Agreement
User acknowledges that Qstation may, with or without notice, modify,
delete, or amend the Services and/or Site provided hereunder. Further,
User acknowledges and agrees that Qstation may further modify, delete
or amend the User Agreement from time to time, including service
fees. Qstation will notify User of any modification in fees by email.
If User does not accept the modification, deletion or amendment,
User must terminate User's account at that time. Any and all use
of the site and services by User after the notice shall be deemed
acceptance of the modification, deletion, and amendment.
Disclaimer
The owner of Qstation provides the content, information, software
and services "AS-IS", with no warranty expressed or implied, including
warranties of merchantability, fitness for a particular purpose
and non-infringement.
User agrees that its use of Qstation and any information obtained
therefrom is at the sole risk of the User. User hereby waives all
claims against the owners of Qstation, Atypica, Inc., their officers,
directors, employees, agents, and representatives, and any Qstation
suppliers or programmers. User agrees to hold harmless, defend,
and indemnify Qstation for all damages that may be incurred by Qstation,
including attorney's fees, related to User's use of Qstation's web
site or User's use of information obtained through User's use of
Qstation web site.
Qstation is not responsible for the contents of any surveys, or
invitations to take surveys, or invitation to view survey results
created on or through Qstation or is it responsible for the responses
submitted to any survey requests or for the results generated by
survey responses. Qstation does not warrant or any representation
regarding the accuracy or reliability of the registration information
supplied to Qstation nor responses or information supplied by users,
panelists or respondees.
Terms of Use
Use agrees not to attempt to damage, deny service to, or hack, crack,
reverse-engineer, or otherwise interfere with the Qstation site
in any manner. If user interferes with the Qstation web site, user
shall pay for all damages incurred, including all consequential
damages. User interference with Qstation web site relieves Qstation
of any and all legal and contractual obligations to User, including
Qstation's obligations under its Privacy Policy.
User agrees that Qstation's liability to User shall be limited
to the amount User has paid Qstation for its services.
User agrees not to transmit through Qstation any materials or
content that is illegal under federal or state laws.
User agrees not to falsify or misrepresent any information provided
to Qstation. User agrees that any information submitted to Qstation
by User become the property of Qstation. The "information submitted"
shall not include information in surveys hosted by Qstation on behalf
of its Users or reponses to such surveys
User represents and warrants that User has ownership or other
authority to post any sound, image, text or other material it posts
on the Qstation web site. Such materials provided by the User shall
remain the property of their owners.
Qstation is intended for survey creators or respondents of the
age of the majority. User agrees not to use Qstation to collect
information from children under the age of 13 without parental permission,
and according to the laws in the minor's locality.
User agrees to hold harmless, defend and indemnify, Qstation from
any liability related to use of the Qstation web site in a manner
that is inconsistent with this User Agreement.
Qstation reserves the right to refuse any or all services to any
User for any reason, at any time.
Qstation reserves the right to take any and all action it may
deem appropriate with respect to violations or enforcement of the
User Agreement, and expressly reserves all rights and remedies available
to Qstation at law or in equity.
Payment Terms
User agrees to pay all charges to User's account, including all
taxes, at the rates in effect when chages are incurred. User must
provide Qstation with valid credit card information, and must promptly
inform Qstation of any and all changes to credit card validity or
expiration date. Qstation will keep the credit card information
confidential and ensure that credit card processing occur in a secure
environment.
User may cancel its account at any time by sending email to customer
service requesting cancellation.
Proprietary Rights
No one may copy or reproduce any part of the Qstation web site without
prior express authorization. Qstation owns the content including
the graphics, names, text, software, survey templates, surveys,
page layout, design, processes, procedures or other material contained
in the web site to the extent such content is provided and/or designed
by Qstation.
